Consequences of withdrawn marriage proposal

In the event that either party refuses to marry without a lawful reason or lawful justification, or if one of the parties invokes the provisions of the record, the following will take place:

  1. The offender of any item of the record does not have the right to the ring in case the other party desires to withdraw from the betrothal.
  2. If the fiancé is the offender, he is not entitled to recover the ring or the gifts presented to the fiancée.
  3. If the fiancée is the offender, she must return the ring or gifts that are not consumable.

The party that decided to withdraw must inform the church of his/her desire to do so by way of a letter signed by him/her (or by an oral approval before one of the priests), and the two betrothed acknowledge that if there is no agreement between them regarding the abandonment of the betrothal, they accept the decision of the Diocesan Clerical Council to resolve the matter and the Council’s decision is final and binding on them.
